1. Agreement

By browsing or buying from this website (the “Site”) you agree to these Terms of Service. If you do not agree with them, please do not use the Site. Read them together with our Privacy Policy and our Shipping & Returns policy, which form part of this agreement.

2. Who We Are

This Site is operated by PALAKOL PHILIPPINES INC. (“Palakol Performance”, “we”, “us”), a corporation registered with the Securities and Exchange Commission of the Republic of the Philippines. 3. Your Account

You can order as a guest or create an account. If you create one, keep your password confidential - you are responsible for activity under your account. Give us accurate delivery and contact details; we cannot deliver an order to an address that does not exist, and a wrong mobile number is the most common reason a courier fails to reach a customer.

4. Products and Pricing

All prices are shown in Philippine pesos and are inclusive of VAT where it applies. We sell and ship within the Philippines.

• Product photography is shot as accurately as we can manage, but screens differ and minor variation in colour or finish is not a defect.
• Specifications such as weight, grip size and core thickness are given to manufacturing tolerance, not to the exact gram or millimetre.
• Prices and specifications can change without notice. The price that applies to your order is the one shown at the moment you pay.
• If a product is listed at a clearly incorrect price because of an error, we may cancel the order and refund you in full rather than fulfil it.

5. Orders

Placing an order is an offer to buy, not a completed sale. The contract is formed when we confirm your payment and send your order confirmation. We may decline or cancel an order - and will refund you in full where payment has been taken - if the item is out of stock, if we cannot verify your details, or if we reasonably suspect fraud or resale in breach of these terms.

6. Payment and Stock Holds

Payment is processed by our payment partners: PayMongo for cards and e-wallets, and Manny Pay for QRPh. Your card details are entered on their systems and never reach ours.

• When you begin checkout we reserve the items in your cart so that nobody else can buy them while you pay.
• That reservation is temporary. If payment is not completed, the stock is released and returned to the shop.
• An order is only confirmed once we receive notification from the payment provider that your payment succeeded. Closing your browser after paying does not cancel your order.

7. Delivery

Delivery times, shipping fees and coverage are set out on our Shipping & Returns page. We hand orders to third-party couriers; once an order is dispatched, delivery timing is in their hands. We will always give you the tracking details we have.

8. Returns, Refunds and Warranty

Your rights under the Consumer Act of the Philippines (RA 7394) apply and nothing in these terms takes them away. How to request a return or report a defect is set out on our Shipping & Returns page. Refunds are issued to the original payment method. Normal wear from play - surface scuffs, grip wear, edge guard marks - is not a manufacturing defect.

9. Ambassador and Distributor Programs

Applying to our partner programs does not create a partnership. Acceptance is at our discretion, and the commercial terms - commission, pricing and any qualifying purchase - are set out in a separate written agreement issued on approval. Referral codes and discount codes remain ours, are personal to the partner they are issued to, and may be withdrawn if misused.

10. Acceptable Use

Use the Site lawfully. You may not attempt to gain unauthorised access to any part of it, interfere with its operation, scrape it systematically, or buy from it for commercial resale without our written agreement.

11. Intellectual Property

The Palakol name and mark, the paddle designs, the photography, the copy and the design of this Site belong to us and may not be copied, reproduced or used commercially without our written permission. Buying a product does not transfer any of these rights.

12. What You Send Us

If you send us content - a review, a photo, a partner application, a message - you keep ownership of it, and you give us permission to use it in connection with our business, including in marketing. Only send us content you have the right to share.

13. Liability

Pickleball is a physical sport. Our equipment is made for recreational and competitive play, and you are responsible for using it appropriately and for your own fitness to play. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability for any order is limited to the amount you paid for it. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.

14. Privacy

How we handle your personal information is set out in our Privacy Policy, including the rights you have under the Data Privacy Act of 2012 (RA 10173).

15. Changes to These Terms

We may update these terms. The version that applies to your order is the one published when you placed it, so changes are not retroactive. The date at the top of this page tells you when it was last revised.

16. Governing Law

These terms are governed by the laws of the Republic of the Philippines, and any dispute will be brought before the courts of the Philippines. If any provision is found unenforceable, the rest continues to apply.
